PEMETAAN BUKTI of PEMBUKTIAN
Untuk menjatuhkan vonis bersalah (*guilty verdict*), sistem hukum pidana mensyaratkan pembuktian yang memenuhi standar Beyond a Reasonable Doubt. Hal ini dicapai melalui pemenuhan dua pilar utama pembuktian berdasarkan Pasal 183 dan 184 KUHAP:
1. Pembuktian Fakta Materil (Corpus Delicti)
Membuktikan secara sah bahwa suatu tindak pidana benar-benar telah terjadi secara nyata, bukan sekadar prasangka, kekeliruan, atau peristiwa non-pidana.
Alat Bukti Fisik & Forensik:- Surat / Keterangan Ahli (Visum et Repertum / Otopsi): Membuktikan luka, racun, atau penyebab kematian secara medis/forensik.
- Laporan Laboratorium Forensik: Membuktikan keaslian zat (narkotika), analisis balistik, atau uji digital forensics (log aktivitas sistem/transaksi).
- Barang Bukti (Real Evidence): Kerusakan fisik di TKP, rekaman CCTV aksi kejahatan, atau manipulasi dokumen keuangan.
- Kesaksian langsung dari saksi yang melihat, mendengar, atau mengalami langsung detik-detik peristiwa pidana.
2. Pembuktian Atribusi Subjek (Direct & Circumstantial Attribution)
Menghubungkan tindak pidana tersebut secara spesifik kepada diri Terdakwa sebagai subjek hukum yang bertanggung jawab atas kejahatan tersebut.
Bukti Pembuktian Langsung (Direct Evidence):- Keterangan Saksi Kunci (Eye-Witness): Saksi yang mengenali dan melihat Terdakwa melakukan kejahatan di lokasi.
- Keterangan Terdakwa (Pengakuan / Confession): Pengakuan Terdakwa di depan sidang yang bersesuaian dengan bukti lain (Pasal 189 KUHAP).
- Bukti Digital / Visual / Biometric: Video beresolusi tinggi atau temuan DNA/sidik jari Terdakwa pada barang bukti utama.
- Kesesuaian Antar-Alat Bukti (Pasal 188 KUHAP): Rangkaian fakta yang saling terhubung (kepemilikan barang bukti, motif, kesempatan di TKP, serta upaya melarikan diri atau menghilangkan barang bukti).

- Tanpa Fakta Materil: Terdakwa tidak dapat dipidana karena tidak ada kejahatan yang terjadi (no crime committed).
- Tanpa Atribusi Subjek: Kejahatan memang terjadi, tetapi Terdakwa wajib dibebaskan (vrijspraak) karena tidak terbukti secara sah sebagai pelakunya.
Evidence Mapping Based on the Two Pillars of Proof
1. Proof of Material Facts (Corpus Delicti)
Material facts establish that a criminal event actually occurred in reality, rather than being mere suspicion, an accident, or a lawful act.

Physical & Forensic Evidence:
- Documentary / Expert Testimony (Visum et Repertum / Autopsy Report): Establishes injuries, poisoning, or the cause of death in crimes against life.
- Forensic Laboratory Report: Verifies substance composition (narcotics), ballistic analysis (bullets/firearms), or digital forensics (system activity logs/fraudulent transactions).
- Real Evidence (Barang Bukti): Physical damage at the crime scene, CCTV footage depicting the criminal act, or falsified financial documents.
- Testimonial Evidence: Testimony from individuals who directly saw, heard, or experienced the execution of the crime.
2. Proof of Subject Attribution (Direct & Circumstantial Attribution)
Once the existence of the crime is established, this pillar serves to link the offense specifically to the Defendant as the legally responsible party.

Direct Evidence:
- Key Eye-Witness Testimony: Witnesses who identified and saw the Defendant committing the crime at the scene.
- Defendant's Statement / Confession: The Defendant’s statement in court that aligns with other admitted evidence.
- Digital / Visual Evidence: High-resolution video footage or biometric traces (such as the Defendant’s DNA or fingerprints isolated on primary physical evidence).

Indirect / Circumstantial Evidence (Petunjuk):
- Inference from Interrelated Evidence: A chain of facts that mutually correspond—such as the Defendant's possession of physical evidence, motive, opportunity (presence at the scene), and subsequent conduct (attempts to flee or destroy evidence).

Absence of Material Fact: The Defendant cannot be sentenced because no crime was committed (no crime committed).
